BREAKING NEWS: Cinpres v. Melea Judgment

Recently, the England and Wales Court of Appeal has presided over the appeal of Cinpres Gas Injection, with regard to their long-running legal battles with Gain Technologies (aka Melea Limited). The details of the decision handed down by the High Court of Justice Chancery Division in September 2006, which ruled in favor of Melea, can be found by clicking here.

There are new developments in the ongoing legal battles between Cinpres Gas Injection and Gain Technologies (aka Melea Limited). A judgement was issued dated 10 September 2006 regarding this latest round of litigation between the two gas assist competitors.

Here is the final ruling from the presiding judge in this case:

Part IX - Conclusion

There were a number of other issues and points in the case, but as some of them were removed by concessions, and in the light of my findings, it is not necessary for me to consider such as were not. My material findings are therefore that the decision in the first proceedings was affected by, and indeed was obtained by, perjured evidence which was material to that decision, but that the benefiting party (Mr Ladney) neither procured nor knowingly took advantage of that perjury. In all the circumstances, despite the perjury by which it was obtained, the 1996 decision in the first proceedings cannot be impeached and governs the issues which would otherwise arise in this action as to the ownership of the patent. Accordingly this action has to be dismissed. I appreciate that that result might be considered by some as less than satisfactory – the entitlement to the patent is governed by a decision which was reached after receiving and accepting perjured evidence and which might have been different if the truth had been told. However, that is the effect of the requirements of the applicable principles, as to which there was no dispute between the parties.

BAUER Wins Patent Suit vs. Epcon

On February 2, 2004, the U.S. Court of Appeals for the Federal Circuit affirmed the lower Court's decision that BAUER Compressors did not infringe and did not have any liability to Epcon Gas Systems for patent infringement. In 1998, Epcon had filed suit against BAUER for infringement of Loren U.S. Patent No. 5,118,455 relating to a certain gas assist injection molding system and process.

In the decision, the Court of Appeals held that the '455 patent could only be infringed if during a gas assist molding cycle, the gas pressure was raised, lowered and held constant, and the gas pressure was "substantially below" the gas storage pressure. There was no evidence that BAUER or any of its customers ever used such a process.

The decision was received enthusiastically by BAUER. As stated by Mr. Paul Dier, BAUER Technical Specialist in the U.S.: "We are glad the lawsuit is finally over. We knew all along that we did not infringe and finally, the Court has vindicated us."

BAUER sells nitrogen generators, compressors, and control units in the United States and has offices in Norfolk, Virginia and Detroit, Michigan.


BAUER & Nitrojection Patents

Middlefield, OH -- Nitrojection, a leading supplier of gas assist technology and equipment, has announced that it has sold their worldwide patent portfolio to BAUER Compressors, Inc.(Norfolk, VA). The purchase agreement between the two leading gas assist suppliers provides BAUER with complete control over Nitrojection's extensive gas assist patent portfolio. The worldwide patents total thirty-five, including twenty one US patents and numerous foreign patents in Europe, Canada and Mexico. The purchase agreement assigns the patents to BAUER and provides Nitrojection Corp. with a non exclusive worldwide license back. The Nitrojection patents are the second largest gas assist intellectual property portfolio controlled by one company. These patents cover gas assist pressurization control units, in-mold Pins, cone check valves and other mechanical devices used in the implementation of gas assist technology. Both parties believe that patent protection for their customers and mutual respect for another company's intellecutal property rights played key roles in getting the license agreement done. Mr. Bill Ridenour of Polymer Transactions Advisors handled the divstiture of the patents. He stated, "Although we contacted most of the key players in the gas assist industry, BAUER's offer was clearly the superior one and in the best interest of my client, Nitrojection." Both BAUER and Nitrojection Corp. will continue to compete in the marketplace, but will not compete in the courthouse where many of their other competitors are currently.


Van Dorn Demag & BAUER Agreement

Norfolk, VA -- BAUER Plastics Technology Group and Van Dorn Demag have reached an agreement to offer an integrated BAUER gas-assist module on Van Dorn Demag injection molding machines. BAUER is the world's leading manufacturer of high-pressure compressor systems. BAUER Nitrogen Gas systems are available for generation and compression of nitrogen and are available in a variety of configurations and pressures.

An integrated BAUER Nitrogen Control Module will offer Van Dorn Demag customers a complete molding machine system for their gas assist applications. This module regulates an individual pressure profile to a single gas injection outlet using a closed loop, programmable logic controller, low-pressure proportional valve and a high pressure dome load regulator. The NCM is capable of controlling the time, pressure and ramp variables of a pressure profile that can consist of up to five pressure setpoints between 0 and 5,000 psig.

Ultimately, this integrated option will allow molders to maximize their production efficiencies. Molders can expect to see warps, sinks and internal stresses eliminated, while at the same time reducing clamp tonnage requirements, cycle time and part weight.

Court Rules in BAUER's Favor in Defense of Patent Infringement Lawsuit.

United States District Court Eastern District of Michigan Southern Division Rules in Favor of BAUER Plastics Technology Group, a Division of BAUER Compressors, Inc.

BAUER Gas Assist Equipment & Methods Do Not Infringe Loren Patent.

Detroit, MI - February 12, 2003 - The extensive legal battle between BAUER Compressors, Inc. of Norfolk, Virginia and Epcon Gas Systems of Troy, Michigan came to a final conclusion in favor of BAUER based on the recent ruling by the U.S. District Court. BAUER's NCU gas control units do not infringe the Loren patent (US No. 5,118,455). There is no evidence that BAUER or any of our customers have ever used an NCU unit in an infringing manner.

According to Jan von Dobeneck, BAUER Compressor's President, "We are very relieved that after four years the case is closed and that we prevented our customers from expensive and unproven claims. Finally, we can continue developing the gas assist process and to help educate molders in this technology."
